This Policy is issued by the Personal Data Administrator DOM REKLAMY ARTOFFICE MARTYNA MĘDREK 8/69 S. Okrzei St. 03-710 Warsaw NIP:717-154-32-77 (hereinafter referred to as DOM REKLAMY ART OFFICE)and is addressed to all users (hereinafter referred to as "Users") of our website (hereinafter referred to as the "Site").

Contact information for the Administrator is provided in Section XI below.

This Policy may be amended and updated to reflect changes in the Administrator's Personal Data Processing practices or changes in common law. We encourage you to read this Policy carefully and to check this page regularly to verify any changes that Administrator may make in accordance with the provisions of this Policy.

  • Processing of Users' Personal Data

Acquisition of Personal Data: The Administrator may obtain Personal Data of Users, such as: name, surname and contact information, including e-mail address. The Administrator may acquire Personal Data of Users, in particular, in the following cases:

  • the provision of Personal Data by Users (e.g. contact by e-mail, telephone, form or any other means).
  • Acquisition of Personal Data of Users as a result of conducting a business relationship / entering into or performing a contract (e.g., purchase of a service or product of the Administrator by a User).
  • Acquisition of Users' Personal Data published on social media (e.g., acquisition of information from Users' social media profile, to the extent that such information is visible as public).
  • To obtain Personal Information from third parties (e.g., from contractors, from financial intermediaries, from law enforcement entities, including administrative authorities or courts, etc.).
  • solicit or ask Users to provide Users' Personal Information, when Users visit the Administrator's sites or use any features or resources available on or through the Site. When Users visit the Site, Users' devices and browsers may automatically share certain information (such as device type, operating system, browser type, browser settings, IP address, language settings, dates and times of connection to the Site and other technical information regarding communications), some of which may constitute Personal Information. When visiting the Site, no Personal Data of Users will be stored by the Administrator without the Users' prior express consent. However, temporary storage of log files and cookies facilitates the use of our Site. For this reason, Users are asked to give their consent to this on our Site. Providing the aforementioned consent is optional and does not affect the ability to use the Site. In some cases, without granting such consent, the ability to use our Site may be limited to some extent.

Personal Data Processed: Categories of Personal Data of Users Processed by ART OFFICE ADVERTISEMENT HOUSE may, in particular, include:

  • Personal Data: first name(s), last name(s), first name used, gender, date, photo.
  • Contact data: delivery address, company (employer) address, telephone number, fax number, email address, social media profile details.
  • Payment details: address for sending settlements, bank account number, name of bank account holder, account security details.
  • Message content: all communications, inquiries, statements, views and opinions about us sent by Users or published on social media or through the Site.

Legal Basis for Processing Personal Data: When Processing Users' Personal Data for the purposes indicated herein, the Administrator may invoke one or more of the following legal bases, as applicable:

  • Processing is based on the User's prior voluntary, specific, informed and unambiguous consent to the Processing;
  • The Processing is necessary for the performance of a contract that the User has entered into or intends to enter into with the Administrator;
  • Processing is necessary to fulfill a legal obligation of the Administrator;
  • Processing is necessary to protect the vital interests of any natural person;
  • Processing is necessary for the management, operation and promotion of the Administrator's business and does not cause prejudice to the interests or fundamental rights and freedoms of the User.

Purposes of Personal Data Processing: The purposes for which the Administrator may process Users' Personal Data are as follows:

  • Administrator's Site: to operate and manage our Site, to present its content; to publish advertisements and other promotional and marketing information; to communicate and interact with customers and suppliers, as well as potential employees or associates, through our Site.
  • Offering the Administrator's products and services to Users: presenting our Site and other services; providing promotional materials at the request of Users; communication related to the Administrator's services.
  • Marketing communications: presenting by any means (including e-mail, telephone, text message, social media, mail and personal contact) messages and other information that may be of interest to Users, including distribution of newsletters and other commercial information, after obtaining Users' consent to send information in an appropriate manner, based on generally applicable laws.
  • Communications and IT operations: management of communication systems, operation for IT security purposes and IT security audits.
  • Financial management: sales, finance, auditing, and sales management.
  • Research: engaging Users to obtain information on Users' opinions about the Administrator's products and services.
  • Improving our products and services: identifying problems with existing products and services; planning improvements to existing products and services; and creating new products and services.
  • Sharing Personal Data with third parties

 

The Administrator may share Users' Personal Data with:

  • To administrative or judicial authorities, at their request, in order to inform them of actual or suspected violations of applicable law;
  • To auditors, lawyers, PR agencies, subject to contractual confidentiality obligations or those burdened by law;
  • To third parties processing the entrusted data on behalf of the Controller regardless of where they are located, as required in this Section III below;
  • To any entity competent for the prevention, investigation, detection or prosecution of criminal acts or the execution of criminal measures, including securing and countering threats to public safety;
  • To any transferee entity, in the event of a sale or transfer of any organized part of the Administrator or shares in the share capital of the Administrator (including in the event of a reorganization, dissolution or liquidation).

Notwithstanding the above, the Site may use plug-ins or content presented by third parties. If Users choose to use them, Users' Personal Data may be shared with third parties or social media platforms. The Administrator hereby recommends reviewing the third party's privacy policy before using its plugins or content.

If we engage a third party to Process Users' Personal Data, pursuant to a processing entrustment agreement with such third party, the Processor shall: (i) Process only the Personal Data indicated in the Administrator's prior written instructions; and (ii) apply all measures to protect the confidentiality and security of the Personal Data and ensure compliance with all other requirements of generally applicable law.

The entity that processes Personal Data of Users obtained through the Website is the company ........................................................... which is the creator of this Site. The technical support service in connection with the use of the Site is provided by the company .................................... This Entity stores and processes the Personal Data of Users obtained during the use of the Site by Users. The Processor shall ensure full security of the Users' Personal Data by using appropriate and latest technical and organizational measures. The Processor shall not use the Users' Personal Data provided to it for purposes other than those for which it was entrusted to it by the Administrator. The Administrator has entered into a Personal Data Processing Entity Entrustment Agreement with the Processor, pursuant to which the Processor has been obligated to comply with the requirements for the protection of Users' Personal Data.

  • International transfer of Personal Data

For the time being, the Administrator does not transfer and does not intend to transfer any Users' Personal Data to third countries that are not members of the European Union or to international organizations. Should the need arise, this Policy will be modified and the transfer of Users' Personal Data will only be allowed under standard contractual provisions that the Administrator will implement prior to the transfer of such Personal Data. In such case, Users will be entitled to request a copy of the standard contractual provisions applied by the Administrator using the contact information indicated in Section XI below.

 

  • Accuracy of Data

The Administrator takes all adequate measures to ensure that:

The Personal Data of Users that the Administrator processes is accurate and, if necessary, updated; and

All Personal Data of Users that the Administrator Processes that is erroneous (given the purpose for which it is Processed) will be deleted or corrected without undue delay.

The Administrator, at any time, may ask Users about the accuracy of the Processed Personal Data.

 

  • Minimization of the scope of Data

The Administrator shall take all adequate measures to ensure that the scope of Users' Personal Data that it processes is limited to Personal Data adequately required for the purposes indicated in this Policy.

 

  • Storage of Data

The criteria determining the length of the period for which the Administrator stores Users' Personal Data are as follows: The Administrator shall keep copies of Users' Personal Data in an identifiable form only as long as necessary to achieve the purposes indicated in this Policy, unless a longer period of retention of Personal Data is required by generally applicable law. The Administrator may, in particular, keep Users' Personal Data for the entire period necessary to establish, exercise or defend claims.

 

  • Users' Rights

In accordance with the provisions of the General Data Protection Regulation, with respect to Users' Personal Data that is Processed by the Administrator, Users have the following rights:

  • The right to access personal data;
  • The right to rectification of personal data;
  • The right to erasure of personal data;
  • The right to restrict the processing of personal data;
  • The right to portability of personal data;
  • The right to object to the processing of personal data;
  • The right not to be subject to a decision involving automated processing.

If the Processing of Personal Data is carried out on the basis of the Users' consent, the Users have the right to withdraw their consent at any time without affecting the legality of the Processing carried out on the basis of the consent before its withdrawal.

In the event of improper Processing of Personal Data, Users have the right to lodge a complaint with the state supervisory authority for data protection, namely the President of the Office for Personal Data Protection.

The above shall not affect the rights of Users under the Acts or other generally applicable laws.

The Administrator uses the following Websites:

When a user uses the Website, data about the user is automatically collected. This data includes: IP address, domain name, browser type, operating system type. This data may be collected by cookies, Google Analytics, and may be recorded in server logs.

Cookies remember the user's preferences, which makes it possible to improve the quality of the services provided, improve search results and the relevance of the information displayed, as well as personalize the Website and create Website statistics.

  • Administrator means the entity that decides how and for what purposes Personal Data is Processed. The Controller is responsible for the compliance of the processing with applicable data protection laws.
  • Personal Data means any information about any identified natural person or an individual who is identifiable. Examples of Personal Data that the Administrator may process are listed in Section II above.
  • Process, Processed or Processed means any action with respect to Personal Data, whether or not performed by automated means, such as acquiring, recording, organizing, structuring, storing, adapting or altering, retrieving, consulting, using, making available by transmission, disseminating or making available by any other means, organizing or combining, restricting, deleting or destroying.
  • Processor means any person or entity that Processes Personal Data on behalf of the Administrator (other than an employee of the Administrator).
